I agree it is reasonable for the Miami-Dade State Attorney, Katherine Fernandez Rundle, to immediately release Mitchell E. Finlay in the interest of balanced justice.
The following facts are relevant:
1. Mitchell has served 22 years in prison after rejecting a plea deal offer of 5 years.
2. Had Mitchell accepted the plea deal, he would have served 3 years.
3. Mitchell’s rejection of the plea deal stemmed from his belief that innocent people do not accept plea deals.
4. Mitchell’s trial attorney was a former prosecutor in Miami-Dade. He has recently documented in writing that the prosecutors offered Mitchell a 5-year plea deal.
5. When Miami-Dade prosecutors offered the 5 year plea deal, they knew that in Mitchell’s home state of Ohio he had a pending grand jury indictment.
6. When the life sentence was imposed by the Miami-Dade trial court, Mitchell had no prior violent crime convictions. His prior conviction was for financial misconduct, nothing to do at all with any violence.
Based on theses facts, I add my name below in support of a second chance for Mitchell Finlay by releasing him to his family immediately.
